Spirit Technique Terms of Service

Please read these Terms of Service (“Terms,” “Terms of Service”) carefully before using the spirittechnique.net website (the “Service”) operated by Spirit Technique, LLC (“us,” “we,” or “our”).

By visiting our site or registering for any Spirit Technique, LLC program, event, or service, you (“you,” “your,” “parent,” or “guardian”) agree to be bound by these Terms.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. If you do not agree with these Terms, you may not use the Service.

1. Eligibility

The Service is intended for use by individuals 18 years of age or older.
Parents and legal guardians may register their children for classes, programs, or events through the Service.

By using the Service, you represent that:

You are at least 18 years old;
You are the legal guardian of any minor you register; and
All information you provide is accurate and complete.

2. Registration & Account Information

When you create an account on our Service, you must provide information that is true, accurate, and complete. You are responsible for:

Maintaining the confidentiality of your account and password
Restricting access to your account
All activities that occur under your account

You agree to notify us immediately of any unauthorized use of your account.

3. Payments Terms

By making a purchase, enrolling in a program, or submitting payment information, you authorize Spirit Technique, LLC to process payments using secure third-party payment processors. These processors may include online payment platforms, credit card processors, and service providers used for registration, tuition, and billing.

Spirit Technique, LLC does not store full credit card information.

All fees, tuition schedules, deposits, or membership charges are outlined at the time of registration and are governed by their respective program policies. You are responsible for ensuring that payment methods remain valid and up to date.

Failure to complete payment may result in suspension of participation in classes or programs.

4. Cancellations, Refunds, and Credits

Refund eligibility varies by program and is communicated during registration. Deposits, tuition, and program fees may be nonrefundable unless otherwise specified.

For ongoing memberships, Spirit Technique, LLC requires advance written notice for cancellation as stated in the specific program's terms.

We reserve the right to modify, cancel, or discontinue any class or program at our discretion. If Spirit Technique, LLC cancels a program, we will issue applicable credits or refunds in accordance with posted policies.

5. Mobile Messaging Terms (A2P Compliance)

By providing your mobile phone number and opting in to receive SMS or MMS messages from Spirit Technique, LLC, you consent to receive recurring marketing and transactional text messages.

Message frequency varies.
Message and data rates may apply.
You may opt out at any time by replying STOP to any message. For help, reply HELP or contact us at [insert email/phone].
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. This includes text messaging originator opt-in data and consent. Exceptions include sharing with our SMS service provider or aggregator solely for the purpose of delivering the messages you have requested, or as required by law.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Spirit Technique, LLC and are protected by U.S. and international copyright, trademark, and intellectual property laws.

You may not copy, modify, distribute, transmit, or use content from the Service without our written permission.

By enrolling in Spirit Technique, LLC activities, you acknowledge that cheer, gymnastics, tumbling, ninja, and related physical activities carry inherent risks.

You agree:

To assume full responsibility for the participant’s safety;
That the participant is physically able to participate;
To release Spirit Technique, LLC and its staff from liability for injuries except where prohibited by law.

Additional waivers may be required during registration for certain programs or events.

11. Limitation of Liability

To the fullest extent permitted by law, Spirit Technique, LLC shall not be liable for:

Indirect, incidental, special, or consequential damages
Loss of data, revenue, or profits
Injuries resulting from participation in physical activities
Interruptions, errors, or security issues related to the Service

Our total liability shall not exceed the amount paid to Spirit Technique, LLC in the twelve months preceding the claim.

Some jurisdictions do not allow certain disclaimers; in those cases, portions of this section may not apply.

12. Indemnification

You agree to indemnify and hold harmless Spirit Technique, LLC from any claims, damages, or expenses arising from:

Your use of the Service
Your violation of these Terms

14. Code of Conduct

We expect all athletes, parents, and guests to conduct themselves respectfully toward staff, coaches, and other participants. We reserve the right to remove individuals from our programs for inappropriate or unsafe behavior without refund.

15. Service Changes & Termination

We may modify, suspend, or discontinue any part of our Services at any time without notice. We are not liable for any modification, suspension, or discontinuation.
